Cooperative birthmother and birthfather:
- Birthfather may sign consent prior to or after delivery
- Birthmother may sign consent 72 hours after the baby is born
- After 30 days, the signed consents are irrevocable
- Petition to Confirm Consent (Court appearance not required)
- Voluntary Relinquishment Petition (Court appearance required)
Cooperative birthmother and uncooperative birthfather:
Alternative Relinquishment proceeding:
Letter is sent to the birthfather who fails or refuses to sign adoption paperwork.
Involuntary Termination of Parental Rights:
Parent desires adoption, fails or refuses to perform parental duties.
Parent knows or has reason to know of the child’s birth, does not reside with the child, or has failed for 4 months preceding petition to make reasonable efforts to maintain substantial and continuing contact with the child or provide substantial support for the child.
No last known address:
If there is no known address for the birthfather a “diligent search” needs to be made and an affidavit is prepared detailing the results of the search. Private Investigator or advertising is necessary.
Unknown birthfather:
If the birthfather is unknown, the birthmother signs an affidavit describing the circumstances of conception; birthfather’s rights not terminated.
