The legal process involved in adoption can seem complicated. Bethany staff members and attorneys are knowledgeable about Tennessee adoption law.
In Tennessee, the legal process is as follows:
- After the baby is born, you, the birthmother, will go to court for a brief, private hearing in which the judge confirms that you are sure about your adoption plan.
- After you sign your surrender you will have 10 days to change your mind. This is considered your “revocation period.”
- The birthfather has the option to sign a waiver before the child is born, or he may also go to court with you to sign a surrender.
- If the birthfather desires to parent (while the birthmother chooses adoption), he must appear in court along with an attorney. At that time, he must prove to the court that he has asserted his paternity and would be a suitable parent.
- Only the mother and father of the baby have rights, even if you are a minor. Neither your parents nor extended relatives can contest your adoption plan.
- Depending on your specific situation, your baby may need a brief interim home provided by one of Bethany's licensed families until you go to court. After your court hearing and revocation period, your child will be placed with the adoptive family you have chosen.
